Dibil Kitchen operates solely as an online marketplace connecting independent third-party sellers (“Sellers”) with buyers (“Buyers”). Dibil Kitchen is not a seller, merchant, manufacturer, distributor, agent, or owner of any products or music publisher listed on the platform and does not take title to, possess, store, inspect, or control any goods offered by Sellers.
All products are offered, sold, and fulfilled exclusively by Sellers. Sellers are solely responsible for:
1.1. Multiple Sellers & Split Shipping
Because Dibil Kitchen hosts independent sellers from various locations, items in a single order may be shipped separately.
Split Delivery: You may receive multiple packages at different times.
Shipping Fees: Shipping fees are calculated per seller/origin. The total shipping fee displayed at checkout is the sum of these individual fees.
All contracts of sale are formed directly between Buyers and Sellers. Dibil Kitchen is not a party to these contracts.
1.2. Order Finality & Cancellations (RA 11967 Compliance)
In strict compliance with the Internet Transactions Act of 2023 (Republic Act No. 11967), Dibil Kitchen prohibits the cancellation of standard, in-stock orders by the Buyer once payment has been securely confirmed and/or the item has been scheduled for courier pickup. Buyers are obligated by law to exercise ordinary diligence before confirming a purchase. All successful checkouts are considered final.
1.3. Authorized Shipping Addresses
To protect both Buyers and Sellers from fraud and rerouting scams, Sellers are strictly instructed to ship orders ONLY to the registered delivery address provided on the official Dibil Kitchen checkout page. Sellers must reject any requests made via direct message to change the shipping address after a payment has been processed.
Dibil Kitchen facilitates payments through third-party processors, including Xendit Philippines, Inc. (“Payment Processor”), acting solely as a limited payment collection agent on behalf of Sellers. Receipt of payment by Dibil Kitchen or its Payment Processor shall be deemed receipt by the Seller.
2.1. Pre-Order Items
Items marked as ‘Pre-Order’ are not yet in stock. The estimated release date is provided by the Seller/Label and is subject to change due to production delays (e.g., vinyl pressing plant delays).
Cancellation Policy: Pre-orders may only be cancelled for a full refund within 24 hours of purchase.
Non-Refundable Deposit: After 24 hours, funds are remitted to the label for production and are non-refundable for ‘Change of Mind’ or buyer-initiated cancellations.
Seller Cancellation: If the Label cancels the project or fails to fulfill the order within a reasonable time (beyond the estimated delay), a full refund will be issued to the Buyer.
Dibil Kitchen is not a bank, electronic money issuer, or financial institution. Payment processing, settlement timing, and fund disbursement are subject to the Payment Processor’s terms, compliance requirements, and Bangko Sentral ng Pilipinas (BSP) regulations, while Dibil Kitchen facilitates a secure internal 7-day holding period (Escrow) to protect both Buyers and Sellers. Dibil Kitchen does not guarantee authorization, settlement, or payout timing.
2.2. Platform Fees and Vendor Payouts
Dibil Kitchen charges a platform commission on all successful sales to cover payment gateway processing and platform maintenance. The specific commission rate and fee structure applicable to your account are detailed during the Seller application verification stage under Vendor Agreement. Order Completion & Payout Schedule: To protect both Buyers and Sellers, funds from a sale remain pending for a strictly enforced 7-day holding period following the delivery of the item. This aligns with our 7-day Refund Policy window. If no dispute or refund claim is filed by the Buyer within these 7 days, the order is officially marked as “Completed” and the Seller’s earnings are cleared. All cleared vendor earnings are tallied and disbursed to the Seller’s designated account at the end of each calendar month.
Dibil Kitchen may provide limited dispute facilitation between Buyers and Sellers for convenience only. Such facilitation does not constitute arbitration, mediation, or assumption of liability. All disputes related to products, fulfillment, refunds, warranties, or Seller performance remain the sole responsibility of the Seller.
3.1. Failed Deliveries & Return to Sender (RTS)
If a package is returned to the Seller due to buyer error (e.g., incorrect address, unavailable to receive, refused acceptance):
No Refund on Shipping: The original shipping fee is non-refundable.
Re-shipping: The buyer must pay a new shipping fee to have the item re-sent.
Forfeiture: If the re-shipping fee is not paid within 30 days, the item may be forfeited to cover storage/handling costs.
Chargebacks, reversals, refunds, fines, penalties, or fees imposed by payment networks, banks, or Payment Processors may be deducted from Seller balances or otherwise recovered from Sellers. Sellers authorize Dibil Kitchen to take reasonable actions to respond to chargebacks, fraud investigations, compliance reviews, or payment disputes.
3.2. Standard Refunds and Damaged Items
For standard, in-stock items, Buyers have a strictly enforced 7-day window from the date of delivery to report missing, incorrect, or heavily damaged items (e.g., severely warped vinyl, unplayable media). Minor cosmetic damage to packaging during transit is at the Seller’s discretion. Buyers must first contact the Seller within this 7-day window with proof to attempt a resolution. If a mutual agreement cannot be reached between the Buyer and Seller, the Buyer may then escalate the dispute to the Dibil Kitchen Admin for mediation. Approved financial refunds will be routed back to the Buyer’s original payment method via our Payment Processor.
To comply with Philippine laws and BSP regulations, Dibil Kitchen and its Payment Processors conduct identity verification, compliance screening, and transaction monitoring.
Sellers must provide accurate and current information and documentation for KYC verification, including legal name, address, government-issued ID, business registration, tax information, and bank account details. Sellers authorize verification, compliance, and re-verification as required.
Dibil Kitchen may delay, suspend, withhold, reverse, or refuse payments; restrict account access; or terminate accounts to comply with AML/KYC obligations, address suspected fraud, or satisfy legal requirements. Such actions may occur without prior notice where permitted by law.
Failure to complete KYC, submission of false or misleading information, or engagement in prohibited activity may result in delayed or forfeited payouts, account suspension, or permanent removal. Dibil Kitchen is not liable for losses arising from good-faith compliance actions.
Users consent to collection, processing, and sharing of personal and transactional data with Payment Processors, financial institutions, and regulatory authorities for AML/KYC compliance, subject to applicable data privacy laws.
By registering as a Vendor on Dibil Kitchen, you explicitly agree to adhere to our Prohibited Items & Anti-Discrimination Policy. We reserve the right to terminate any Vendor account immediately, without refund, if these rules are violated.
5.1. The Golden Rule:
Dibil Kitchen has a zero-tolerance policy for hate. You may not list, sell, or promote any items (music, merchandise, zines, or art) that promote, support, or glorify hatred, violence, or discrimination against people based on race or ethnicity, religion, gender identity or sexual orientation, disability, or nationality.
5.2. Specifically Prohibited Content:
We will immediately remove items affiliated with hate groups (e.g., NSBM, white supremacist, or neo-Nazi organizations), items featuring hate symbols used in a hateful context, and content that encourages violence against marginalized groups.
5.3. Artistic Expression vs. Hate Speech:
We understand that punk, metal, and underground art often feature horror, anti-establishment, or extreme themes. Shock-value art is allowed. However, if that art crosses the line into targeting real-world marginalized groups with genuine malice, it will be taken down.
5.4. Platform Discretion:
Dibil Kitchen reserves the right to determine what constitutes hate speech or prohibited items on our platform.
5.5. Illegal Substances and Contraband:
The sale of illegal drugs, drug paraphernalia, regulated narcotics, prescription medications, firearms, weapons, or any other items strictly prohibited by Philippine law is strictly forbidden. Dibil Kitchen actively monitors listings and will immediately terminate, permanently ban, and report any Seller attempting to distribute unlawful physical goods through this platform.
Sellers guarantee that they own or have the proper licensing and authorization to sell the music, artwork, and merchandise listed in their store. The sale of pirated media, unauthorized bootlegs, counterfeit merchandise, or items that infringe on the intellectual property rights of others is strictly prohibited. Dibil Kitchen complies with takedown requests from rightful copyright owners and will remove infringing listings immediately.
To the maximum extent permitted under Philippine law, Dibil Kitchen disclaims all warranties, express or implied, relating to third-party products or Seller conduct, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Products are provided by Sellers “as is” and “as available.”
Dibil Kitchen shall not be liable for damages arising from third-party products, Seller acts or omissions, payment failures, settlement delays, chargebacks, fraud, or disputes, except where liability cannot be excluded by law. Dibil Kitchen is not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, revenue, data, or business.
Buyers and Sellers agree to indemnify, defend, and hold harmless Dibil Kitchen, its officers, directors, employees, and partners from claims, liabilities, damages, losses, penalties, fines, costs, and expenses (including legal fees) arising from:
These Terms are governed by the laws of the Republic of the Philippines. Any disputes arising from these Terms are subject to the exclusive jurisdiction of the proper courts of the Philippines.
